The Trademark Clearinghouse (TMCH) is the central database for trademark information, created by ICANN to provide brand protection to trademark holders during the launch periods of the new domain extensions.
This article will explain:
If you are a brand owner and have registered trademarks then you need to also register them with the TMCH. This will provide protection for your online presence and prevent infringement or abuse of your marks during the launch phases of the new domain name extensions. It is the only way you can protect your intellectual property during the new gTLD program as you are granted exclusive access to the priority Sunrise phases.
The validation process can take a couple of weeks so the sooner you register, the better. Even if you are not planning to register during any of the Sunrise phases, the TMCH also offers the Trademark Claims service which is further protection against possible trademark infringement.
The Sunrise phase is an exclusive registration period reserved for trademark holders. During this phase, only trademark holders registered with the Trademark Clearinghouse can register domain names. Only domain names that identically match a trademark can be registered.
The Sunrise phase lasts at least 30 days. But for some extensions it can last longer.
Working with our subsidiary eBrand Services, and as an official accredited TMCH agent, we can submit your trademarks to the TMCH and register your brand during the Sunrise phases.
We’ve also developed a unique TMCH platform that monitors the new domains after the TMCH alert system ends, providing ongoing brand protection.
Once registered and verified, you will receive an SMD key proving that you are a trademark holder/agent registered with the TMCH and allowing you to register the corresponding domain name in any new extension, before they become available to the public.
Contact your account manager for advice on which trademarks you should register and help with your TMCH application.
An SMD or Signed Mark Data file/key is proof that you are a trademark holder/agent registered with the TMCH. This document is compulsory if you want to register domain names during any of the Sunrise/Trademark holder phases.
The Trademark Clearinghouse is the entity generating the SMD key. In order to obtain this document, please email our Sales team at firstname.lastname@example.org to discuss signing up for the Trademark Clearinghouse.
The TMCH Claims service is for trademark owners registered with the TMCH. For the first 60 days (minimum) following the Sunrise phase, trademark owners and registrants will be alerted to a domain name registration attempt that matches a registered trademark. After the initial 60 days, registered trademark holders will continue to receive alerts indefinitely.
During the Sunrise phase, the registration duration is set to two years. You cannot register your domain name for less than two years nor for more than two years.
